Booking Terms and Conditions for Pound Farm Holidays.

1.Contract

The contract for a short-term holiday rental will be between Pound Farm Holidays (referred to as “Pound Farm Holidays”, “Orchard Lodge” “Woodpecker Lodge” “We” or “Us”)  and the person making the booking under the following booking conditions. UK law will govern the Contract. The contract of hire is not effective until we have received and processed the deposit. The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and the booking form must list names, addresses and ages of your party. You are responsible for ensuring that all members of your booking party comply with the Terms of Use (as set out below), however, the Contract for the provision of accommodation is between us and you (as the person making the booking).

2. PAYMENT

Bookings are confirmed on receipt of the booking form and receiving the deposit of 30% of the holiday cost. The balance of the rental & the security deposit (£100) will be due for payment six weeks before the start of your holiday.  We will send you a reminder when the balance is due.  The balance should be paid within 3 days of receipt of the reminder.  We reserve the right to cancel a holiday where payment has not been made within a week of notification of the balance being due. If the booking is made within six weeks of the holiday start date, then payment will be due in full.

3. CANCELLATION

Customer inability (or the inability of any, some or all of your intended occupants) or disinclination to travel to and stay at Pound Farm for any reason.

This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, a call to jury duty, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport.  These remain at your risk and do not give rise to a right to cancel or to receive a refund unless we re-let the property, Pound Farm Holidays strongly recommended to take out UK travel insurance to cover these eventualities. If you choose not to take out UK travel insurance then you accept responsibility for any loss that you may incur due to your cancellation.

Travel insurance

It is the responsibility of the Lead Guest to acquire suitable travel insurance for themselves and their party to cover their holiday, including Cancellation and Curtailment Protection Insurance.  We strongly recommend that you take out suitable insurance which will cover you for possible cancellation of your UK holiday.

Any Cancellations, for any reason,  must be immediately notified to Pound Farm Holidays and confirmed in writing. The treatment of a cancellation will depend on: The date the booking was made, when the cancellation was made and the reason for the cancellation.

Refunds 

We will try our utmost to re-let. If we are successful we will refund the final letting price (which may be less than you paid) less the 30% deposit. If we are unable to re-let a booking cancelled within six weeks of the date of stay then you are liable for the whole cost of the holiday. We strongly advise that you take out holiday cancellation insurance as a safeguard.

Cancellation by us

If we (Pound Farm Holidays) have to cancel your booking for any reason, including a Force Majeure event, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, you will be refunded in full.

(a) acts of God, flood, drought, earthquake or other natural disaster

(b) epidemic or pandemic

(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations

(d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent

(f) collapse of buildings, fire, explosion or accident

(g) any labour or trade dispute, strikes, industrial action or lockouts

(h) non-performance by suppliers or contractors; and

(i) interruption or failure of utility service, and the period of closure covers you booking

The owners reserve the right to close facilities at any time for maintenance or repair.

 

4. NUMBER OF PERSONS USING THE PROPERTY

Up to the maximum number of 4 people (+ 2 - sofa bed in lounge to accommodate 2 guests by prior arrangement). Please note there is an additional charge of £25 per person per night for any guests using the sofa bed.

The Lodge may be occupied only by the guests named on the booking form. We reserve the right of entry to the Lodge at any time and to cancel the booking if additional guests stay in the Lodge.

Electricity, Duvets, Pillows, bed linen, bath, hand & tea towels are all included in the price.

Cots (but not cot bedding) and highchair are available by prior arrangement.

5. PERIOD OF COVER

The Lodge will be available from 4.00pm on day of arrival and must be vacated by 10.00am on day of departure.  Please do not arrive before 4pm, this gives us time between bookings to give it a thorough clean. Please ring if you are running late. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. 

6. CARE OF THE PROPERTY

The Lodge should be left clean and tidy (including kitchen, cooker, oven, BBQ, etc) on departure, as found on arrival. Failing this, we reserve the right to levy a cleaning charge. Smoking is not allowed in the Lodge.

7. DAMAGES & BREAKAGES 

Please report breakages, spillage or damage immediately. The owners reserve the right to charge for breakages/ damage (although we would not charge you for the odd glass or plate).  Payment of the security deposit does not limit guest’s liability for repair of damage or additional cleaning.

8. PETS

We welcome well behaved dogs accepted by prior arrangement at £30 per dog, per stay. Dogs must never be left alone in the Lodge and must not sit directly on the furniture. If your dog is likely to jump onto furniture, please bring covers for furniture and use the one provided. Dog(s) are not allowed in the bedrooms, damage/muddy bed sheets, duvets will have to be paid for.

Dog(s) must be kept on leads at Pound Farm and poop should be scooped. Pet hairs should be removed before departure. There are footpaths in our area for you to walk your dog and the village of Butterleigh has a field. “Butterleigh Meadow” Our fields are sometimes stocked with animals depending on what time of year, so they are not always suitable for dog walking, but please ask on your arrival and we will advise on suitable fields for you to walk through. (Maximum of two dogs.) Leave all gates as you find them.

9. LIABILITY

The owners shall not be liable for any loss or damage or personal injury (whether consequential or otherwise) to any property which you or any other person may suffer or sustain arising from Pound Farm and its facilities and grounds. The owners will not be liable for any inconvenience, annoyance, loss or damage (whether consequential or otherwise) in the event of any or all your booked accommodation being unavailable under this agreement for any reason save that we will repay all monies paid.

Cars are parked on the premises at your own risk.

10. FARM HEALTH AND SAFETY – SUPERVISION

We want you to have a safe and enjoyable stay but please remember farms can be very dangerous places.

No unaccompanied children in the farmyard, their safety is your responsibility, do not enter any of the farm buildings, barns or sheds without permission. Do not climb on any bale or wood stacks. Do not play or climb on any equipment or machinery including tractors.  We do have large vehicles visiting and working on the Farm (such as lorries, Farm vehicles and delivery trucks.) 

You are responsible for the full active physical supervision of all members or your party and those under the age of 18 at all times. 

Show respect for the animals and wildlife on the farm and move quietly around them, DO NOT chase any animals.

 

11. FISHING 

We provide a small Fishing Pond which is heavily stocked with Roach, Rudd and Perch. (Barbless hocks, catch & immediately release) You will be able to fish as many times as you like during your stay at no extra cost. Children can only fish under your supervision, their safety is your responsibility. No night fishing.

 

12. ELECTRIC VEHICLE CHARGING POLICY  

Domestic charges are not permitted at the Property.

 11.1  Most EVs are supplied with a domestic charger, commonly known as a ‘granny charger’ or a ‘trickle charger’. These cables recharge the EV using a domestic power source via a 3-pin wall socket.

11.2  Domestic chargers are not suitable for use at the Property and will create a fire hazard. The use of domestic chargers is strictly forbidden.

11.3  We retain the right to carry out reasonable inspection, on a without notice basis, to ensure that granny chargers are not in use in the Property.

11.4  You are solely liable for any damage or loss suffered by us as a result of your unauthorised use of domestic chargers.

 

13. WHAT’S NOT ALLOWED AT POUND FARM

1/ Electric Vehicle charging is not allowed

2/ Under no circumstances are you to bring electrical appliances to Pound Farm other than laptops and phone chargers, without explicit written permission. Guest appliances have not been PAT tested and could invalidate our insurance. We will levy a charge if we find they have been operating without consent.

3/ Fireworks and Chinese Lanterns are explicitly forbidden at Pound Farm. The whole surrounding area is a tinder box in summer and there are livestock on pretty much all the fields surrounding Pound Farm.

4/ Whilst reasonable numbers of visiting guests are allowed, additional overnight guests are not. The Lodge occupancy limits are clear on the website. This could invalidate our insurance.

5/ Guests who invite visitors who have dogs, must check with us first. Any visiting dogs must abide by our Doggy Code of Conduct

6/ If you have booked more than one Lodge, please don’t move items either internal or external from one Lodge to another. If you would like to move something, a BBQ for example, we can arrange safely moving these and then re-installing them.

7/ Drones are not allowed to be flown at Pound Farm. Other guests may be present and we wish to protect their privacy.

8/ No metal detecting at Pound Farm.

9/ No unaccompanied children in the farmyard

 

It is essential that the person making the booking bring these T&C to the attention of all members of the holiday party.
