Booking Terms and Conditions for Pound Farm Holidays.

 

 

1. CONTRACT

The contract for a short-term holiday rental will be between Pound Farm Holidays (referred to as “Pound Farm Holidays”, “Orchard Lodge” “We” or “Us”)  and the person making the booking under the following booking conditions. UK law will govern the Contract. The contract of hire is not effective until we have received and processed the deposit. The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and the booking form must list names, addresses and ages of your party. You are responsible for ensuring that all members of your booking party comply with the Terms of Use (as set out below), however, the Contract for the provision of accommodation is between us and you (as the person making the booking).

2. PAYMENT

Bookings are confirmed on receipt of the booking form and receiving the deposit of 30% of the holiday cost. The balance of the rental & the security deposit (£100) will be due for payment six weeks before the start of your holiday.  We will send you a reminder when the balance is due.  The balance should be paid within 3 days of receipt of the reminder.  We reserve the right to cancel a holiday where payment has not been made within a week of notification of the balance being due. If the booking is made within six weeks of the holiday start date, then payment will be due in full. The security deposit will be refunded following your stay providing the Lodge is vacated on time and left in a clean & tidy condition, without damage or breakages, within 10 days of your departure.

Electricity, Duvets, Pillows, bed linen, bath, hand & tea towels are all included in the price.

Cots (but not cot bedding) and highchair are available by prior arrangement.

3. CANCELLATION

Bookings placed before 05 February 2021  are covered on a different set of terms & conditions and are available by emailing poundfarmholidays@btconnect.com if these apply to your booking.

For Bookings placed from 05 February 2021 these new terms and conditions apply to cancellations

National lockdown- in the event of a national lockdown that coincides with your holiday, where you are unable to travel, and we are prevented from opening, you will receive a full refund.

 

Regional/local lockdown – in the event that your address given on booking is put into Local/Regional lockdown, rendering you unable to travel, and the period of restriction covers the period of your booking, you will receive a full refund. Please note that this applies to the address given on the booking by the leader booker and does not apply if an unidentified party member at a different address is unable to travel due to local lockdown.

If your booking has to be cancelled because Pound Farm Holidays is put under Government Restrictions and has to close and the period of closure covers your booking you will be refunded in full.

 

Customer inability (or the inability of any, some or all of your intended occupants) or disinclination to travel to and stay at Pound Farm for any reason.

This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, a call to jury duty, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport.  These remain at your risk and do not give rise to a right to cancel or to receive a refund unless we re-let the property, other than according to the sliding scale below. Pound Farm Holidays strongly recommended to take out UK travel insurance to cover these eventualities. If you choose not to take out UK travel insurance then you accept responsibility for any loss that you may incur due to your cancellation.

Travel insurance

It is the responsibility of the Lead Guest to acquire suitable travel insurance for themselves and their party to cover their holiday, including Cancellation and Curtailment Protection Insurance.  We strongly recommend that you take out suitable insurance which will cover you for possible cancellation of your UK holiday.

Covid is also now a known risk and it is possible for you to insure your holiday against it. This can include the customer or any of the party having Covid, the customer or any of the party having to isolate or quarantine, or you wishing to shield any Members of the party.

Any Cancellations, for any reason,  must be immediately notified to Pound Farm Holidays and confirmed in writing. The treatment of a cancellation will depend on: The date the booking was made, when the cancellation was made and the reason for the cancellation.

Refunds 

All refunds will be subject to deduction of a non-refundable administration fee of £20 to cover our costs and third party costs related to the cancellation and remarketing (these costs include our admin costs,  re-marketing costs, bank fees, accounting fees and agency fees or commission payments).

A cancellation charge will be made based on the number of days notification of cancellation given by the person making the booking to Pound Farm Holidays and whether the Lodge is re-let for the period of the cancelled stay. Pound Farm Holiday will apply the scale shown in the table below to determine the amount of the refund payable to you.  If the Lodge is not re-let, this will be a percentage of the total cost of the holiday.  If the Lodge is re-let, the amount refunded will be the rebooking value (which may be less than you paid) less the non-refundable administration fee of £20. 

Part Cancellations – If any person(s) in your party needs to cancel, this will not affect the total cost of your booking.  In addition, no refunds are payable in the event that you cut short your stay. 

The Security deposit will be repaid in full on all cancellations.

Cancellation by us

If we (Pound Farm Holidays) have to cancel your booking for any reason, including a Force Majeure event, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, you will be refunded in full.

(a) acts of God, flood, drought, earthquake or other natural disaster

(b) epidemic or pandemic

(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations

(d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent

(f) collapse of buildings, fire, explosion or accident

(g) any labour or trade dispute, strikes, industrial action or lockouts

(h) non-performance by suppliers or contractors; and

(i) interruption or failure of utility service, and the period of closure covers you booking

 

4. NUMBER OF PERSONS USING THE PROPERTY

Up to the maximum number of 4 people (+ 2 - sofa bed in lounge to accommodate 2 guests). Please note there is an additional charge of £10 per person per night for any guests using the sofa bed.

The Lodge may be occupied only by the guests named on the booking form. We reserve the right of entry to the Lodge at any time and to cancel the booking if additional guests stay in the Lodge.

5. PERIOD OF COVER

Orchard Lodge will be available from 4.00pm on day of arrival and must be vacated by 10.00am on day of departure.  Please do not arrive before 4pm, this gives us time between bookings to give it a thorough clean. Please ring if you are running late. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. 

6. CARE OF THE PROPERTY

Orchard Lodge should be left clean and tidy (including kitchen, cooker, oven, BBQ, etc) on departure, as found on arrival. Failing this, we reserve the right to levy a cleaning charge. Smoking is not allowed in the Lodge.

7. DAMAGES & BREAKAGES  

Please report breakages, spillage or damage immediately. The owners reserve the right to charge for breakages/ damage (although we would not charge you for the odd glass or plate).  Payment of the security deposit (£100) does not limit guest’s liability for repair of damage or additional cleaning.

8. PETS

We welcome well behaved dogs accepted by prior arrangement at £20 per dog, per stay. Dogs must never be left alone in the Lodge and must not sit directly on the furniture. If your dog is likely to jump onto furniture, please bring covers for furniture. Dogs must be kept on leads at Pound Farm and poop should be scooped. Pet hairs should be removed from carpets before departure. There are footpaths in our area for you to walk your dog and the village of Butterleigh has a field. “Butterleigh Meadow” Our fields are usual stocked with animals, so they are not always suitable for dog walking. (Maximum of two dogs.)

 

9. LIABILITY

The owners shall not be liable for any loss or damage or personal injury (whether consequential or otherwise) to any property which you or any other person may suffer or sustain arising from Pound Farm and its facilities and grounds. The owners will not be liable for any inconvenience, annoyance, loss or damage (whether consequential or otherwise) in the event of any or all your booked accommodation being unavailable under this agreement for any reason save that we will repay all monies paid.

Cars are parked on the premises at your own risk.

No unaccompanied children in the farmyard, do not enter any of the farm buildings, barns or sheds. Show respect for the animals and wildlife on the farm and move quietly around them, DO NOT chase any animals.

No metal detecting on the farm.

10. FISHING  

We provide a small Fishing Pond which is heavily stocked with Roach, Rudd and Perch. (Barbless hocks, catch & immediately release) You will be able to fish as many times as you like during your stay at no extra cost. Children can only fish under your supervision, their safety is your responsibility. No night fishing.  

It is essential that the person making the booking bring these T&C to the attention of all members of the holiday party.
